40 and 44 hours workweeks – application schedule and differences

Since revision of the Labor Standards Act (LSA), 40 hours workweek system has been adopted by most companies in Korea. The only segment left uncovered by the system at this time is companies with less than 20 employees. 40 hours workweek and related  work conditions in the LSA will apply to those companies before the end of 2011. The specific date has yet to be decided by the presidential decree. (Addendum of the LSA)

The problem is most foreign companies in Korea usually starts with employees fewer than 20. This means that those companies are basically under the 44 working hours system under the labor standards act before 2003 revision.

Although, most of starting foreign companies I have seen for the past few years seem to adopt the new 40 working hours system regardless of their size, it won’t hurt them to know what the differences are between the old and new systems.

So here they are.

  1. i am an undocumented worker for 3 years and we are only two working in this factory, my companion is legal (EPS), am i covered with the 40 hours working time because the new law only specified 20 workers less, and my employer insist that i am not entitled because we are only two. thank you…

    1. @mylene Unfortunately, no matter what kind of answer I give to you, it will not solve your problem because I am not the authority but just a blogger.   2. when this 40 hrs per week implemented…our company has almost 50 workers… and how about the annual paid leave every workers can avail these… ?

    where i can find a manual like this issue… labor office?

    1. If your company has about 50 workers, it is already covered by 40 hours work system. From July 2011, the 40 hours work will also apply to companies with 20 or less workers. Annual leave applies to every worker.

  3. Hi. 40 hour work week will be extended to companies with less than 20 employees from July 1, 2011. Until then, annual leave of 15 days is not mandatory for those companies. Therefore, 10 days annual leave is still valid for an employee hired before July 1 of next year.

  4. Hi. Labor standards act prohibits discrimination against employees based on gender, nationality or belief. Therefore, if you worked for a company for more than a year, you are entitled to 15 days of annual leave from the second year and the leave will increase by one day for each two year worked until up to the ceiling of 25 days.     I have a question regarding Annual leave and
    promotion for use of leave is this also applicable to all foreign workers? because in our company their system is if you have absent plus one day deduction in your salary i work here in almost 4 years straight and we do not have any leave with pay..
